(Re) Pensando los géneros en la justicia

Through a qualitative approach, the need to transform the Argentine justice system with a gender and human rights approach is sustained, since without ignoring the policies and spaces with competence in the matter that have been progressively installed within the justice system, a power structure still persists that, because it is designed and managed with little mainstreaming of the gender perspective, deploys actions that violate the fundamental rights of women and LGBTIQ+.
Therefore, through three sections it will be stated that, despite the sanction of new and better rights that place access to justice as a universal human right, women and LGBTIQ+ still face obstacles in terms of recognition, redistribution and participation derived from the paradigm androcentric. Finally, some dimensions are proposed from which to continue thinking and reflecting on the development of mechanisms that guarantee a feminist and transfeminist judicial reform.
