The agony of sex as a legal category.

This article analyses self-perceived gender identity legislation and registration regulations regarding the inclusion of sex as a category in identity documents and the tensions generated between this two. This leads to questioning states interest in maintaining biological sex as a sacred category. To do so, the theoretical framework applied leaves behind the experience that comes from the LGTBIQ+ regarding the subject in study and adopts the “queer theory”. In the end I will entertain two proposals: implementing an open catalogue of identities to submit in legal documents or the abolition of sex as a legal category.
